WHAT TYPES OF PERSONAL DATA DO WE COLLECT AND PROCESS

In the course of our activities at Moto-Nautika d.o.o., we collect and process the following types of personal data: name and surname, contact details (address, email address, phone number), product data (e.g., make and model, homologation number, performed service and warranty services, etc.), web cookies, social media data, and data on channels and applications used by the individual.

LEGAL BASIS FOR PROCESSING PERSONAL DATA AND PURPOSES OF PROCESSING

  1. Processing of personal data for the purpose of service provision

    Moto-Nautika d.o.o. processes collected personal data of individuals for the purpose of providing services (order fulfillment, free service checks, warranty claim processing, notification of serial defects or recalls or safety notices, etc.) and maintaining contact with the individual through various channels.

  2. Processing of personal data based on customer consent
    The processing of personal data may also be based on the specific consent of the individual, which allows Moto-Nautika d.o.o. to use their personal data for the purposes defined in the consent, namely for:

    – receiving general news, including updates, benefits, offers, invitations to events, invitations to participate in prize draws, and invitations to participate in surveys and research;

The users of personal data are employees and contracting partners of Moto-Nautika d.o.o., who are bound by the Labor Relations Act, personal data processing agreements, or confidentiality agreements to respect and protect individuals' personal data. PERSONAL DATA PROTECTION

The retention period for personal data depends on the legal basis and purpose of processing for each category of personal data. Personal data is retained only for as long as it is necessary to achieve the purpose for which it was collected or further processed. Personal data will be deleted, destroyed, blocked, or anonymized after the purpose of processing has been fulfilled, unless there is another legal basis or it is necessary for the establishment, exercise, or defense of legal claims.

RIGHT-HAND SIDE

Moto-Nautika d.o.o. provides individuals whose personal data it processes with the opportunity to exercise their rights, namely:

  • right of access to personal data collected about them;
  • right to correction, that Moto-Nautika d.o.o. corrects inaccurate personal data concerning him without undue delay;
  • right to erasure, that Moto-Nautika d.o.o. shall erase personal data concerning him without undue delay where one of the following grounds applies:
    • personal data are no longer necessary for the purposes for which they were collected or otherwise processed,
    • the individual withdraws consent on which the processing is based, and where there is no other legal ground for the processing,
    • the data subject objects to the processing, and there are no overriding legitimate grounds for the processing,
    • personal data was processed unlawfully,
    • as the law dictates.
  • right to restriction of processing, when one of the following applies:
    • The individual disputes the accuracy of the data, specifically for the period that allows Moto-Nautika d.o.o. to verify the accuracy of the personal data,
    • is processing unlawful and an individual objects to the erasure of personal data, and instead requests the restriction of their use,
    • Moto-Nautika d.o.o. no longer needs personal data for processing purposes, but rather the individual needs it to assert, exercise, or defend legal claims,
    • If an individual has lodged an objection to data processing, until it is verified whether the controller's legitimate reasons override the individual's reasons. Where the processing of personal data has been restricted in accordance with the preceding paragraph, such personal data, other than for storage, shall only be processed with the consent of the data subject, or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person. Moto-Nautika d.o.o. shall inform the individual before the restriction on processing is lifted.
    • An individual can submit a request in a manner that allows for their identification, namely through an oral request to be recorded at a branch, a written request, or a request submitted via email.

Data protection requests are handled by the Data Protection Officer. Moto-Nautika d.o.o. is obliged to respond to an individual's request without undue delay, or at the latest within one month.

Moto-Nautika d.o.o. provides the requested information to an individual free of charge. However, when an individual's requests are manifestly unfounded or excessive, particularly due to their repetitive nature, Moto-Nautika d.o.o. may:

  • charge a reasonable fee, taking into account the administrative costs of providing information or communication or performing the required action or
  • refuse to act on the request.

CONTRACT IN THE CASE OF IMPOSSIBLE DECISION OF THE CONTROLLER AND THE RIGHT TO APPEAL TO THE SUPERVISORY AUTHORITY

If an individual believes that the personal data received based on a request to exercise their rights from the previous point of these General Information is not the personal data they requested, or that they have not received all the requested personal data, they may file a reasoned objection within 15 days before lodging a complaint with Moto-Nautika d.o.o. Moto-Nautika d.o.o. is obligated to decide on the objection within 5 working days.

In case of silence from the controller (i.e., if Moto-Nautika d.o.o. does not respond to an individual's request to exercise their rights within 1 month), the individual may file a complaint with the supervisory authority for silence.

If the controller's response is definitively negative, an appeal is possible, and the supervisory authority is competent to handle it. The individual may file an appeal with the controller within 15 days of receiving the controller's response.
